These Terms & Conditions govern your use of Wilde Gourmet website and services, including the purchase of gourmet gift boxes, wine, food items, and subscription boxes (“Products”). By accessing our website or placing an order, you agree to these Terms.

2. Eligibility to Purchase

To purchase Products from The Wilde Company, you must:

- Be at least 18 years old (required for alcoholic products)
- Provide accurate, current, and complete information during checkout
- Agree to these Terms

We reserve the right to refuse service or cancel orders at our discretion.

 

3. Product Information

We strive to ensure that all product descriptions, images, and details are accurate. However:

- Items included in hampers may occasionally vary based on availability
- Substitutions will always be of equal or higher value
- Colours, packaging, and presentation may vary slightly due to photography and natural materials

 

4. Pricing & Payment

Prices are displayed in Euro (€) and include VAT where applicable.
We accept payment through secure online providers (e.g., card, PayPal, or others you specify).

Wilde Gourmet reserves the right to update prices at any time.
Prices at time of purchase are final.

 

5. Orders & Availability

An order is considered accepted once you receive an order confirmation email.
If a product becomes unavailable after purchase, we will contact you to offer:

- A suitable substitute
- A refund
- A change in delivery date

We reserve the right to refuse or cancel orders in cases of suspected fraud or incorrect pricing due to system error.

 

6. Delivery

We deliver across Malta (and Gozo if applicable).

 

Delivery Requirements

- Customers must provide accurate delivery information.
- If the address is incorrect or incomplete, we are not liable for failed delivery.
- Additional fees may apply for re-delivery.

Delivery Times

We aim to deliver on the selected date or within the stated timeframe.
However, delays may occur due to:

- Weather
- Courier issues
- Seasonal peaks (e.g., Christmas)

 

The Wilde Company is not liable for delays outside our control.

7. Alcohol Policy

By purchasing hampers containing wine or other alcoholic beverages, you confirm that:

- You are 18 years or older
- The recipient (if gifting) is also 18 years or older

Couriers may request age verification upon delivery.

 

8. Refunds, Returns & Cancellations

Our full Refund Policy applies and is incorporated into these Terms.

Key points:

- Due to the nature of food and beverage items, returns are not accepted.
- Damaged or incorrect items must be reported within 48 hours with photos.
- Orders may be cancelled before dispatch (see full policy for details).

9. Gift Orders

If an order is marked as a gift:
- No pricing information will be included in the delivery
- Issues or damages may be reported by either the buyer or the recipient

 

10. Subscription Services – Wilde Gourmet Club

Subscription options (3, 6, or 12 months) renew or continue according to your chosen plan.

By subscribing, you agree that:

- Your payment method may be charged on a recurring basis
- You can update, pause, or amend delivery details at least **5 days** before dispatch
- Refunds cannot be issued for delivered subscription boxes

We reserve the right to modify subscription offerings or pricing, with notice to subscribers.

 

11. Use of Website

By using our website, you agree not to:

- Engage in fraudulent activities
- Interfere with the website’s operation (e.g., hacking, scraping, DDOS)
- Copy or reproduce content without permission

All images, designs, text, and branding are the property of The Wilde Company.

 

12. Privacy & Data Protection

Wilde Gourmet complies with the General Data Protection Regulation (GDPR) and Maltese data protection laws.

We collect and process data only for:

- Order fulfilment
- Customer service
- Marketing (only with consent)

We never sell personal data to third parties.

13. Limitation of Liability

Wilde Gourmet is not liable for:

- Allergic reactions where ingredients are listed or known
- Delays caused by couriers or external factors
- Damages caused by incorrect handling after delivery
- Losses arising from misuse of products

Our liability is limited to the value of the order in question.

 

14. Force Majeure

We are not responsible for failure to perform obligations due to events beyond our reasonable control, including:

- Natural disasters
- Strikes
- Transport disruptions
- Pandemics
- Supplier failures

 

15. Governing Law

These Terms & Conditions are governed by the laws of Malta and applicable EU regulations.
Any disputes shall be subject to the exclusive jurisdiction of Maltese courts.

 

16. Amendments

Wilde Gourmet may update these Terms at any time.
Changes will be posted on our website and will apply immediately to new orders.
Continued use of the website implies acceptance of updated Terms.
